General Terms and Conditions Verstappen Coaching & Counselling©

 

1. Applicability

These general terms and conditions apply to all agreements between Max Verstappen, psychologist (MSc), hereinafter referred to as ‘the service provider’, and the client, regarding psychological consultations and related services.

 

2. Services

The service provider offers psychological consultations aimed at supporting clients with mental health issues, personal development, or other psychological matters. The specific nature and objectives of the services will be determined in consultation with the client.

 

3. Costs and Payment

The fee for the services will be agreed upon in advance with the client. Payment must be made within 14 days of the invoice date via bank transfer. In case of late payment, the service provider may charge €100 statutory interest and collection costs.

 

4. Cancellation Policy

Appointments must be cancelled at least 24 hours in advance via email or telephone. For cancellations within 24 hours or no-shows, €60 will be charged.

 

 

5. Privacy and Data Protection

The service provider processes personal data in accordance with the General Data Protection Regulation (AVG). For more information, see the privacy statement.

To secure client files on my MacBook Pro, I create an encrypted disk image using Disk Utility with 256-bit AES encryption, setting a strong, unique password for access. I save this password-protected DMG file in an iCloud Drive folder to enable secure cloud backup, ensuring it syncs with my available iCloud storage.

 

 

6. Confidentiality

All information shared during consultations is confidential and will not be disclosed to third parties without the client’s consent, except where required by law.

  1. Suspicion
    Do I, based on steps 1 through 4 of the reporting code, have a suspicion of (threat of) domestic violence and/or child abuse?

No: Close and record in file
Yes: Proceed to consideration 2.

  1. Acute or structural unsafety
    Do I estimate, based on steps 1 through 4 of the reporting code, that there is acute unsafety and/or structural unsafety?

No: Proceed to consideration 3
Yes: Report to Veilig Thuis. Considerations 3 through 5 are gone through together with Veilig Thuis.

  1. Provide or organize help myself
    Am I able to provide or organize effective help to avert the threat of (future) domestic violence and/or child abuse?

No: Report to Veilig Thuis
Yes: Proceed to consideration 4.

  1. Acceptance of help
    Do the involved parties accept help to avert the threat of (future) domestic violence and/or child abuse and are they willing to commit to it?

No: Report to Veilig Thuis
Yes: Provide or organize help, proceed to consideration 5.

  1. Desired result
    Does the help lead within the desired timeframe to the necessary results regarding the safety and/or well-being (recovery) of all involved?

No: (Re)report to Veilig Thuis.
Yes: Conclude help with agreements on monitoring future (un)safety with involved parties and collaboration partners.

 

 

7. Record Keeping

The service provider maintains records of the consultations, which are securely stored for a minimum of 20 years, in accordance with the Medical Treatment Contracts Act (WGBO).

 

 

8. Liability

The service provider is not liable for damages resulting from the services provided, except in cases of gross negligence or intent.

 

 

9. Complaints Procedure

In case of complaints, the client may contact the service provider via email or telephone. If the complaint is not resolved, the client may use the complaints procedure of the Netherlands Institute of Psychologists (NIP), see https://nip.nl.

 

 

10. Applicable Law

These general terms and conditions are governed by Dutch law.

 

 

11. Amendments to the Terms

The service provider reserves the right to amend these general terms and conditions.

 

 

12. Insurance Reimbursement

The services provided by the service provider are not eligible for reimbursement under basic health insurance. Clients are responsible for payment of the costs. Clients are advised to check with their health insurer whether the services are eligible for reimbursement under supplementary insurance. The service provider does not guarantee reimbursement.
